RELEASE AND WAIVER LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT")

In consideration of participating in RelyFit Training Studio I represent that I understand the nature of the activity and that i am qualified, in good health, and in proper physical condition to participate in such physical activity Acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releases" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in this activity. I hereby release, discharge, and covenant no to sue Arely Chavez. Its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owner agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owner and lessons of premises on which the activity takes place, (each considered one of the "releases" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the "releases" or otherwise, including negligent rescue operations and future agree, that if, the negligence of the "releases" or otherwise, including negligent rescue operations and future agree, that if, despite the release waiver of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the releases, I will indemnify, save and hold harmless each of the releases from any loss, liability, damage, or cost which may incur as the result of such claim.

I have read the RELEASE AND WAIVER LIABILITY, ASSUMPTION OF RISk, AND INDEMNITY AGREEMENT, understand that I have give up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full forced effect.

PARENTAL CONSENT

AND I, the minor's parent and/or guardian, understand the nature of the above referenced activities and the Minor's experience and capabilities and believe the minor to be qualified to participate in such activity, I herby Release, discharge, covenant, not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releases from all liabilities, claims, demands, losses, or damages on the minor's account caused or alleged to have been caused in whole or in part by the negligence of the Releases or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor's behalf makes a claim against any of the above Releases, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releases from any litigation, expenses, attorney fees, loss liability, damage, or cost any Release may incur as the result of any such claim.

I agree to allow photographs/videos of me taken by RelyFit Training to be used as a portfolio to show, publish, and to use for any purpose or any format.

I am the parent or legal guardian of the minor and agree to allow photographs/videos taken by RelyFit Training to be used as a portfolio to show, publish and to use for any purpose or any format.

RELEASE OF LIABILITY FOR MINOR

To: D&A Capital LLC / DBA RelyFit Training Studio

Activity: During any class held at RelyFit Training Studio children are welcome to wait in an "unsupervised" waiting area/room while their parent/guardian participate in Studio activities. RelyFit Training Studio may provide a limited amount of chairs at a first come first serve basis for the children that choose to not wait in the waiting area/room. The chairs will be set up (only by a RelyFit employee) and must remain in the same spot at all times. The chairs should not be moved for any reason unless instructed and approved by a (RelyFit employee). All Children must stay away from the Training/Workout area at all times during any class that is in session. It is the parent/guardians responsibility to keep their child/children in compliance with RelyFit Training Studio policy and guidelines.

I completely understand and realize that RelyFit Training Studio does not offer childcare of any kind. I am also completely aware that by allowing my child/children (under the age of 18) to participate in the above mentioned activity could result in actions and tasks that may be dangerous or hazardous to them, to which RelyFit Training Studio is not held liable for.

D&A Capital LLC/DBA RelyFit Training Studio Owners and Managing Members reserve the right to deny service to anyone for any reason.

If denied service for any reason and asked to leave by any Managing Member you will not be refunded unless approved by upper management.

By signing below, I agree to the fact that participation may cause harm or injury to my child/children. I release the organization or business named above from all liability, costs and damages which could arise from participating in the above activity. I agree to accept financial responsibility for the costs related to this emergency treatment and give my confirmation of the same by signing this document.
