ThisI, {{first_name}} {{last_name}} (the authorized legal representative of {{first_name}} {{last_name}}), acknowledge and understand that I am
participating in the classes given by the Lorenz Latin Dance Studio (the "Studio"), during which I will receive information and instruction about either dance or fitness and will participate in dance exercises and perform dance poses and techniques. I recognize that dancing requires physical exertion which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the dance/fitness/zumba classes. I represent and warrant that I am in good health and physically fit, and I have no medical condition which would prevent my full and safe participation in the classes.
In consideration of being permitted to participate in the dance classes, I agree to assume full responsibility for any risks, injuries, damages or dangers, known or unknown, which I might incur as a result of participating in the classes. I knowingly, voluntarily and expressly waive, to the fullest extent permitted by law, any claim against the Studio, including its owners, teachers, or agents, for any injury or damages that I may sustain as a result of participating in classes. To the fullest extent permitted by law, I for myself, and for my family members, heirs, legal representatives, forever release, waive any claims against, and covenant not to sue the Studio, Howard Lorenz, Patricia Lorenz, teachers and/or agents, for any injuries or damages caused by or arising out of my participation, or any of their acts or omissions. I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated and will make all payments necessary for participation in the Studio's activities.

1. I agree that I am personally responsible for my safety and actions while using the LORENZ LATIN DANCE STUDIO (the "Studio"). I agree to comply with all Studio policies and rules, including, but not limited to, all Studio policies, guidelines, signage and instructions whether on premises, provided via email to you, orally in the Studio, or posted online via social media or website. Because the Studio is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, 1, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the Studio, its governing members, officers, agents, servants, independent contractors, affiliates, employees, helpers, paid or unpaid interns, successors and assigns (collectively the "Released Parties") from any and all liability, claims, demands, actions and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third party using the Studio, or otherwise, while participating in any activity while, in, on, or around the Studio and/or while using any Studio facilities, tools, equipment, or materials.
2. I agree that I have taken, to the best of my ability, all safety precautions required by New York State prior to entry. I agree that all members of my party including myself, shall wear a face mask covering the nose and mouth, disinfect hands upon entry, and throughout my stay, maintain social distance with other people (outside of your own group) and our staff. I acknowledge that the Studio is not required or obligated to provide face masks or any other preventative materials for an individual. I agree that I am responsible to provide my own preventative materials, masks, equipment and protective wear as required herein.
3. I agree that, to the best of my knowledge, I am not ill or exhibiting any symptoms of any illness including but not restricted to, fever, cough, excessive sneezing, sore throat or any other symptom indicative of an illness.
4. I declare that I have not contracted COVID-19 or traveled to or from a place that requires self-quarantine by NYS within the last 14 days. I declare, that to the best of my knowledge, I am not infectious of COVID-19 and that I take all necessary precautions in my daily life to prevent the spread of COVID-19.
5. I agree that I shall behave responsibly to reduce the spread of COVID-19 as it is in the interest of public safety. If my behavior is deemed unsafe, the Studio, its teachers and staff reserve the right to discontinue service, restrict, prohibit or expel customers in the interest of public safety. Unsafe behavior includes non-compliance of State laws on COVID-19, non-compliance of our policies and behavior which increases another person's risk of being infected by COVID 19. I agree that the Studio shall have the right to assess behavior taking place at ANY time on premises or outside of our premises and at times prior to, during or after a visit to our premises as it pertains to my ability to access the Studio premises. The Studio shall have the right to accept information or witness testimony provided by health officials, the State, building management, social media or Studio staff to deny access to our premises until COVID-19 restrictions are fully lifted.
6. I agree to indemnity, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the Studio facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.
7. By signing below, I acknowledge and represent that I have read the foregoing agreement and Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document. I am sufficiently informed about the risks involved in attending the Studio to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full adequate and complete consideration fully intending to be bound by the same. I agree that if I fail to adhere to the terms of this agreement I shall be subject to immediate expulsion from the Studio, without refund, solely at my cost. I agree that this Waiver of Liability shall be governed by and construed in accordance with New York law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provisions) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole. 1. TUITION PAYMENTS ARE DUE IN FULL AT THE BEGINNING OF EACH MONTH FOR ALL CLASSES REGISTERED FOR. IF YOUR TUITION IS NOT PAID IN FULL, LLDS HOLDS THE RIGHTS TO DENY YOUR ATTENDANCE OF CLASS(ES).
2. Your tuition grants you four (4) classes a month. Tuition payments (including Gift Certificates) are non-refundable and are not discounted for any classes missed, closures/ cancellations due to holidays or inclement weather, nor are credits given.
3. If you miss a class, you are entitled to take another class within the same month in which the class was missed. A missed class CANNOT be carried over into following months.
Please note: any class that you select as a "make-up" will be either one month ahead or one month behind your class and does not guarantee you will learn the step(s) you might have missed in your own class.
4. FOR CHILDREN'S CLASSES: Parent's are allowed to observe during the first class only.
Parent's will not be allowed to spectate outside of the first class, and we ask that you drop off/pick up children on time. Children's classes do not have make-ups, credits, or discounts for any missed classes.
5. Parents of children are required to be at the studio premises at the end of their child's class to pick them up. Lorenz Latin Dance Studio is not responsible for any students who choose to not attend class after being dropped off, or who choose to leave the studio premises during/ following their class.
6. Lorenz Latin Dance Studio is not responsible for the loss/theft of any articles brought into, or forgotten at studio premises.
7. Lorenz Latin Dance Studio reserves the right to terminate dance instruction of any student at any time, with or without cause.
8. I give permission for the public display of any studio pictures/videos that I, or my child, may be in, to promote Lorenz Latin Dance Studio.
